Just send it back in. You have a 3-year warranty. I still have my 360 from launch day and it just RROD last week for the first time.

1) December 07 is not even close to "new".

2) You thought wrong. MS still hasn't resolved the issue at this point. You could buy one off the shelf right now and it could break in a week.
