He's obviously not guilty until proven innocent, but I get what you're saying. The evidence will come back, and he'll be guilty automatically. There is no law and never will there be a law in the USA that says guilty until proven innocent. That just won't happen.
But your friend did the right thing. Always refuse a field sobriety test, but you can't refuse at a medical facility. Hopefully he was .08 at the traffic stop (if he would have taken the test), but was .07 at the medical facility! It happens.
