      LOS ANGELES — A former high school football star whose rape conviction was thrown out plans to file a claim against the state but will not sue the woman who recanted the sexual assault claim she made a decade ago.

      An attorney for 26-year-old Brian Banks tells the Los Angeles Times his client will seek $100 from the state for every day he was wrongfully incarcerated. Seeing how he was jailed for a little over five years, that amount is near $200,000.

      Banks walked free on Thursday. He spent five years in prison after pleading no contest to forcible rape.

      Wanetta Gibson was a high school sophomore when she accused Banks of raping her. She received a $1.5 million payment from a civil suit brought by her mother against Long Beach schools.

      Prosecutors have said they have no plans to charge Gibson, now 24, with making false accusations, saying it would be a tough case to prove.
      For $200,000 the state should write the check tomorrow.

                Apparently he got tryout invites from Seattle, Washington, and Kansas City. They just want to make headlines at this point. Not nearly as badly as the Arizona Diamondbacks who have offered him a "front office and other athletic interests" position.

                        Brian Banks, 26, was recently exonerated after spending five years in jail, then another five on parole. Now he's getting a chance with the Seahawks and coach Pete Carroll, who had once recruited him to play linebacker at USC.

                          Everyone's client says that. However, three things should come out of this:

                          1. His lawyers should be looked in to. Why the fuck would you advise your client plead no contest? Talk about incompetent. Isn't there a way to get a lawyer disbarred for gross negligence?
                          2. Whatever police investigation went through on this, needs to be re-examined.
                          3. I'm with Shogun. Throw her under the fucking jail.

                            Because there probably wasn't any more evidence other than "your word against her's" and when all you have gamble is 5 years (get out of prison when you're 23 and still have your life ahead of you, albeit harder) versus going for the trial and risking a much, much longer penalty... If he didn't take that plea deal he'd probably still be in prison and she might not have decided to contact him. She didn't contact him until AFTER he got out.

                            2. Whatever police investigation went through on this, needs to be re-examined.
                            Probably, but it's really not the point. The evidence available is the evidence available. No witnesses, his word against hers.

                            3. I'm with Shogun. Throw her under the fucking jail.
