I think it's a common sense ruling. The EU is to be one market, to allow the Premier League to flout those rules seems counter intuitive. From what I understand, the rates Sky charges in the UK are rather high. Perhaps this is a signal that the market can no longer bear those costs
More thoughts - much of what is being proposed to 'aid' the Premier League just seems to punish the fans who want to watch. As we've seen in North America, blacking out games does not equal increased attendance. Fans who want to stay at home and watch the match can be monetized in other ways (merch, etc) and to punish them by not allowing them to see their favorite team seems silly.
Pushing more copyrighted material into a program to 'protect' the Premier League also seems silly. By doing this, it seems likely to annoy the already watching customers. A shitty song after every goal? When United or Chelsea is putting 8 past Wigan, that's going to get old very quickly. A decision to allow pan-European right sales should mean that broadcasters now have more customers to target
