SOUTH BEND, Ind. -- The son of former Notre Dame standout Joe Montana was among 11 Fighting Irish athletes arrested on misdemeanor charges of underage drinking at a party Friday night.

A total of 44 people were arrested after city police responded to a call about a fight near a roadway and discovered the party, said St. Joseph County Police assistant chief Bill Redman.

Two non-athletes face a misdemeanor charge of providing alcohol to minors. The arrests were handled by state excise police, who didn't immediately return a message seeking comment on Saturday.

The most recognizable athletes arrested were Nate Montana, a walk-on who was the backup to starter Dayne Crist coming out of the spring, and Tim Abromaitis, the second leading scorer on the Irish basketball team at 16.1 points a game last season.

Montana spent last season as a backup at Pasadena City (Calif.) College. Several incoming freshmen are expected to compete with him for the No. 2 spot when practice begins next month.

The other athletes arrested were wide receivers Robbie Toma and Tai-ler Jones, linebacker Steve Filer, kicker Nick Tausch, cornerback Lo Wood, and offensive linemen Chris Watt and Tate Nichols; incoming freshman point guard Eric Atkins; and incoming hockey goalie Steven Summerhays.

Most of those arrested had been released on $150 bond, Redman said. They are scheduled to make court appearances July 30.

If convicted, each faces a maximum sentence of 30 days in jail.

Notre Dame coach Brian Kelly said he was aware of the arrests and was gathering information.

"If there is any team-related discipline to be issued, it would be handled internally," he said.

Bernie Cafarelli, Notre Dame's sports information director, said basketball coach Mike Brey also would handle any punishment internally.

Incidentally, the younger Montana, now playing for UW, was on the same team playing quarterback with Wayne Gretzky's son... Will Smith's older son played receiver. Saw that in a Yahoo! article last year.

This really isn't at all surprising.

The excise police, State Troopers, and to some extent the South Bend local PD have the reputation for being dickheads.

Now these kids have to deal with ResLife at Notre Dame, AND the court system. The code of Du Lac is a pain in the ass to a lot of students there.

Wrong. South Bend cops all want to be recognized throughout the country. This is their chance. Remember when Jimmy Clausen was arrested? He had his dad in the car, but also had a case of beer that his dad had just bought. Do you honestly think that if I am driving my father to go get beer, and I get pulled over for whatever reason, I would get arrested for having the alcohol in my car? No, probably not even in South Bend. Because I'm not some five star athlete for the University of Notre Dame.

Clausen was never arrested. He was simply ticketed.

Also it wasn't with his dad. It was with a recent graduate who was 23 years old.

They were caught during an Excise Police sting.

SOUTH BEND — Maybe someday Jimmy Clausen will make headlines for something he actually does on the football field — not for ornate announcements with stretch Hummers, not for clandestine elbow conditions, and, most recently, not for a minor scrape with the law.

It has recently come to light that the University of Notre Dame freshman quarterback was cited for transporting alcohol as a minor in connection with a June 23 incident at a local liquor store.

Indiana State Excise Police cited the 19-year-old Clausen and a 23-year-old outside the Belmont Beverage store at 1621 South Bend Ave., near the Notre Dame campus, police said.

Excise police were in an unmarked car outside the store to catch minors attempting to get alcohol, said Lt. Tim Cleveland, a police spokesman.

Clausen, the nation’s No. 1 recruit in the last recruiting cycle and currently battling for the starting quarterback job at Notre Dame, received a misdemeanor citation, police said. The 23-year-old, a recent Notre Dame graduate, was cited for inducing a minor to possess alcohol, an infraction.

Clausen, through the university, declined comment Friday. Notre Dame head coach Charlie Weis also declined comment.

The 23-year-old entered the store and bought two 1.75-liter bottles of Smirnoff vodka and a 200-milliliter bottle of Jack Daniel’s whiskey, police said, as well as a case containing 30 cans of Natural Light beer.

Clausen remained outside the store in a Chevrolet Tahoe along with another Notre Dame freshman, who was not cited. Because the older man bought the alcohol, police said, the store was not cited.
The 23-year-old did not return a phone message Friday left with his father.

Clausen entered a pretrial diversion program with the St. Joseph County prosecutor’s office, said Linda Scopelitis, who directs the program.

Under the terms of the agreement, signed on July 11, Clausen agreed to pay a $170 fee and to not commit a similar offense for a year, Scopelitis said.

If Clausen meets those terms, he will not face a misdemeanor charge for the June incident, she said. But if he is cited for the same offense within a year, he will face two misdemeanor charges.

Such diversion agreements generally require people to perform community service or attend alcohol education programs as well, Scopelitis said, adding that the prosecutor’s office relies on the university to provide alcohol education for its students who enter the diversion program.

Clausen must also likely deal with the university’s layer of justice, as well as that of Weis. The Office of Residence Life and Housing is responsible for serving as hearing officers for student disciplinary issues, and issues such as this typically end up in that arena.

Clausen’s splash of a recruiting announcement in April of 2006 at the College Football Hall of Fame, orchestrated by a public relations firm, slammed the Californian into college football’s consciousness.

He enrolled early at Notre Dame, in January, in order to better compete for the vacant starter’s job at QB with sophomores Demetrius Jones and Zach Frazer and junior Evan Sharpley. Frazer, the odd man out after spring practice, has since transferred to Connecticut.

The condition of Clausen’s right (throwing) elbow in spring practice was the source of much speculation, particularly after his father, Jim Clausen, publicly acknowledged a chronic elbow condition. Clausen then underwent surgery in May but has been practicing with the team since Aug. 6. The extent to which he has recovered is uncertain.

The Irish open the season at home Sept. 1 against Georgia Tech.

South Bend police said they were dispatched to the neighborhood at 1:41 a.m. on the report of about a dozen people fighting, throwing punches near the corner of Washington and Eddy streets, one block north of Jefferson Boulevard.
Upon arrival, officers heard glass breaking from the back of the residence and immediately called for more units. South Bend police said pandemonium began to occur, with numerous men and women jumping out of windows and off the roof of the residence.

Excise Police officers arrived at 1:53 a.m., according to a news release, and 15 or more South Bend police officers left their patrol beats from across the city to assist and catch people who were fleeing, police said.

After about an hour, when the chaos was under control, police said they began gathering, arresting and transporting underage people to the county jail.

South Bend police said the residence is a frequent destination for police dispatches. Several arrests were previously made at the address for underage drinking, narcotics, resisting law enforcement, and attempt to disarm a police officer.

South Bend fire and medics also were called to the house for a woman who cut her arm while breaking a window, trying to get out of the house. She was taken to Memorial Hospital, the news release from Excise Police said. Several other people fled the scene and were not caught, police said.
Redman said bond was set at $150 for each person arrested.

All 44 people arrested had bonded out of the county jail by Saturday afternoon. They are due in court July 30, Redman said.
