In Kansas you can refuse, but your license automatically gets suspended for a year. I don't know how they don't allow you to refuse in other states. That should be your right to choose. I've never heard of a guy getting taken to the hospital to get blood work done. That's crazy.

In California, like most stats, you have the right to refuse any field sobriety test or breathalyzer. Most law enforcement will lie, bully, and try to convince you that you must do exactly what they say. You don't have to. You don't have to let them search your car, you don't have to answer any questions, you don't have to submit to any testing, UNTIL they take you to a medical facility for testing. If they take you to a medical facility for testing, you MUST comply, and take a blood or urine test. ALWAYS ask for a second test to be done at a different facility for independent analysis. If you've incriminated yourself earlier by taking an FST or breathalyzer, then law enforcement will most likely not comply, but it's worth asking.

The only time in California that you will be penalized for refusing to take any sobriety test, will be at a medical facility or police station, where law enforcement will have a licensed medical practitioner administer a blood test. If you deny a blood test, you will be automatically charged with the highest DUI punishment, and your license will be suspended for an extra year on top of DUI sentencing.

The report I read said that Ward failed a field sobriety test and refused a breathalyzer.

That shit doesn't work in Texas. I had a friend refuse a breathalyzer a few weeks ago and they hauled him to the hospital and took his blood with a warrant. Now he has to wait a few weeks for the results to come back but in the meantime he was booked on suspicion of DUI and is guilty until proven innocent.

He's obviously not guilty until proven innocent, but I get what you're saying. The evidence will come back, and he'll be guilty automatically. There is no law and never will there be a law in the USA that says guilty until proven innocent. That just won't happen.

But your friend did the right thing. Always refuse a field sobriety test, but you can't refuse at a medical facility. Hopefully he was .08 at the traffic stop (if he would have taken the test), but was .07 at the medical facility! It happens.

Iowa's implied consent law...

Driving is a privilege not a right.

A refusal of a alcohol and or drug test is treated by Iowa DOT as admitting guilt. License automatically revoked for 1 year for refusal (for first offense, over age of 21). You will not be eligable for a temporary/work/school license. Even if the arrest was unlawful or you were found not guilty for OWI, your license will still be revoked for 1 year.

You can refuse any FST without penalty. Just don't refuse any chemical test (datamaster) after an officer has informed you of Iowa's Consent Law.

We (Iowa) do not typically draw blood or do urine samples due to a refusal.

Was he involved in a crash? In MD, if you are involved in a crash that results in any kind of serious injury, yours included, you HAVE to submit to a test. Blood will be taken. Otherwise you can refuse any tests but your license will be automatically suspended.

I'm just being facetious, being charged on suspicion just seems like a way to say "we think you are guilty and let's go to the test results since we can't prove it immediately".

He refused the test after being stopped to by himself some more time. I'm afraid he might still be over though. He left the bar the same as a group of our friends that were staying at his house and then missed the exit to his house and drove another 40 miles through 2 more counties before getting pulled over...

No crash, the officer that pulled him over said that he was driving too slowly and appeared to be driving erratically in his lane. My friend had a good attitude about the arrest. Said he was just glad that he didn't hurt anybody and that was a lesson he had probably needed to learn for 15 years (having a few at a bar and then getting behind the wheel thinking he was ok to drive).
