The NFL, the Favre's, media, are basically saying she's lying or questioning her motives. If the NFL takes action against Brett, and Sterger doesn't make financial demands, her name is cleared.

There is no better bellwether of what the NFL wants you to believe than the Monday Morning Quarterback column, mostly because there is no one more firmly lodged in Roger Goodell's khakis than Peter King. So when King writes this about the Favre investigation, it's worth paying attention:

King — and whoever at the NFL is whispering in his ear — would have you believe the Favre personal-conduct investigation is some sort of legal proceeding, with standards of proof and bagged evidence and grave people debating epistemology at large oaken tables. It's nothing like that, of course. The league suspended Ben Roethlisberger from deep within the shadow of a doubt and then justified it by pointing to "a pattern of behavior," which is really just a mealy-mouthed way of saying "some other stuff we did a shitty job of hushing up."

If the NFL chooses not to punish Favre — and based on what we're hearing, that's where this is headed — the decision will have precious little to do with what the NFL could and couldn't prove; it'll be a PR calculation just like anything else.

The St. Paul Pioneer Press reported this back in October....extortion plain and simple.

The investigation into whether Vikings QB Brett Favre violated the NFL’s personal conduct policy when he was a Jet in '08 by allegedly texting obscene photos, in addition to other conduct, to then Jets employee Jenn Sterger has been sent to Commissioner Roger Goodell's office for review, Sterger’s attorney Joseph Conway said. Conway said that Joseph Hummel, Dir of Investigative Services in the NFL’s Security Department, called him yesterday in response to calls Conway placed regarding a report that Favre would not be disciplined. When he asked Hummel about it, Conway said, “His answer back to me was that the case was out of their hands. He sent it upstairs and it is in the Commissioner’s office and the lawyers were looking at it.” NFL Senior VP/PR Greg Aiello confirmed in an e-mail that the Favre-Sterger matter was now under review in the Commissioner’s office. Aiello said, “We have not reached a conclusion. When we do, we will communicate it to the appropriate parties.” Conway said he would be “extremely disappointed” if a report by SI.com’s Peter King that Favre would receive little or no discipline was true and accurate. But the idea that the alleged transmission of the obscene photos was the only act that violated the conduct policy is wrong, Conway said. “If anyone portrays this as a one-time incident, that would be completely incorrect. This is a pattern of behavior on his part that took place over a very long period of time. There were repeated attempts to contact my client.” Deadspin.com first published the photos and voicemails allegedly from Favre in October in a report that caused the NFL to launch the investigation. But Conway said that the NFL was provided with much more information than was contained in the Deadspin report. “We were extremely cooperative with the NFL,” Conway said. “We provided them with the names of others they could contact. I believe, based on what we turned over to them, that there is sufficient evidence to find he was in violation of the personal conduct policy.”

So now Jen Sterger's manager is trying to strong arm the NFL and says they won't sue the Jets or the league if they suspend Favre. The more he talks the more any doubts are removed that this is all a play for money. He's so stupid that he tells Dan Patrick everything and expects the NFL to respond in his favor. Even if Goodell wanted to suspend Favre, he can't now because it would give the appearance that if you strong arm the NFL you can get your way. I have the feeling that their promises to not sue the Jets, the league and/or Favre are hollow as well because a suspension would be an admission of guilt that opens up the civil courts.

We assume that Phil Reese thinks he’s helping his client, Jenn Sterger, find a new job in the media. We assume that neither Reese nor Sterger realize that Reese is actually, in our view, doing more harm than good.

Reese’s latest attempt to change the perception that Sterger was at best a willing participant in some type of flirtation with Favre (thanks to the account provided by former Sterger friend Allison Torres) and at worst an opportunistic gold digger who is manipulating the situation either to enhance her career or line her pockets came on Thursday’s edition of The Dan Patrick Show. Specifically, Reese told Dan Patrick that Sterger won’t sue anyone if the NFL suspends Vikings quarterback Brett Favre.

“If the Commissioner suspends Favre and puts in a program to make sure this doesn’t happen again . . . 100 percent. Jenn would not pursue any litigation against Favre, against the Jets, against anybody,” Reese told Patrick.
Reese also is frustrated by the fact that a decision has not yet been made.
“I don’t know what’s taking so long here,” Reese said. “We have done everything to assist the investigation. We have gone above and beyond. We’ve been told the league is going to do the right thing.”

Um, Phil? One reason for the delay is that your client waited for weeks to decide whether to “do the right thing” and talk to the league, presumably after exhausting all efforts to finagle a settlement and deciding not to sue Favre. Reese also seems to think that the league should merely take Sterger at her word, without any attempt to resolve via objective evidence what ultimately appears to be a he-said, she-said conflict as to whether Favre took and sent intimate photos to Sterger while both were working for the Jets.

To the extent that some believe Sterger eventually will sue the Jets, possibly for ending her tenure after one year due in whole or in part to her alleged concerns regarding Favre, Reese gutted any such claim by making it clear that Sterger never said a word to the Jets about the situation for fear of losing her job.

“No, she did not complain to the organization,” Reese told Patrick, explaining that she instead confided in people in the industry.
From a legal standpoint, Reese essentially has placed Sterger in checkmate, without the NFL having to move barely any pawns. From a practical standpoint, this entire episode is assuming (in our opinion) a Tonya Harding vibe, and for reasons neither known nor apparent Reese now wants the league to take a metal stick to Brett Favre’s kneecap.

Regardless of what the league decides to do, we know that no amount of huffing and puffing from Sterger or her manager or her lawyer will persuade the NFL to do what Sterger or her manager or her lawyer want the NFL to do.

So far her spokespeople have promised "No Money" and that she has not asked for any money. I'll wait till it happens before I accuse her of it.

But you go ahead and convict the one that really hasn't done anything wrong in this and give passes to the guy that has done something wrong.

Why not just wait to see what happens first. If Brett gets suspended and Sterger sues Brett, the Jets, or the NFL, I'll admit you were EVENTUALLY right. Until then, you have nothing to base your accusations on. While defending the guy that does have evidence against him.

.. that's the one thing the Sterger-camp has done right. We don't know what kind of communications the two had.

There is evidence that he has, but there is no evidence that she has. What you and Mr. Bill are doing is saying Duck Wentworth is guilty of extortion cause we don't know he isn't. I say, lets wait and see if Ducky is guilty of anything or not guilty. See the difference.

The funny thing is that it doesn't even matter anymore. Favre is just going through the motions at this point playing out a lost season. Who cares what happens.

I did hear today that apparently the investigation has been concluded and the report has been given to Goodell and NFL lawyers for review. This might actually all be concluded next week.

Agreed that the whole story is a joke. Favre saw a hot woman and went after her like a lot of other married guys have done to their detriment. Based on interviews with Sterger's friend, we know that the conversation was mutual and that Sterger was a willing participant in whatever they had going on. That stands to reason since it's doubtful Favre texted a picture of his junk if she had at any time said "do not call or text me again".

If suspend Favre or we'll sue you isn't blackmail, I don't know what is these days.
