Maynard is usually decent 50% of the time so I will due him the favor of laying it out for him in this thread.
1.) When you make a business agreement, you uphold your side of the deal. When that doesn't happen, feathers are usually rumpled. Initially we agreed to sell VSN in it's shitty/corrupted form to TGL and combine the communities. In return we would be given control over the forums to run it as we please (myself and houtz) and they would concentrate on their product (The Madden Lab) and the home page. With me and houtz running the forum, it wouldn't have been bad at all.
Our plan was to replicate VSN and ban their idiot members. However we weren't given the ability to do any of this as we were given the deputy mod abilities. Over 100+ VSN guys didn't even get a chance to post on TGL because they never gave us editing abilities to edit the 100+ usernames that were called "Imported_username" that happens when you use the ImPex import for members in a vBulletin merge. We were supposed to add the VSN skins, smilies, fix post counts, edit usernames, and were never given the permissions to do so. Causing people to flip shit, be upset, stay unhappy, and bitch. Rightfully so that is.
2.) Gambino agreed to send us $8,000 in this "deal". There was a contract and he breached it. He told us VSN's members sucked, our community was ruining things, and he had no problem banning the ones who caused any sort of problem or left criticism as to how things were ran on his business....yes he referred to it as his business...not his forum. It wasn't even so much about the money, it was about him completely banning off all of our good members. When he banned Epidemik, I said fuck it. Read the Tales of the TGL Staff forum thread in the Locker Room. The evidence is overwhelming that they gave no shit about VSN or it's community. They had fucking Top 3 lists of who they wanted to ban the most from VSN. Give me a break.
3.) Argath has already ran over the parameters of this "breached contract".
"As for the database/suing shit, I'm sure you realize that databases are:
1)Not copyrightable under US law as a database is viewed as a source of general knowledge
2)Anything which houses illegal materials or reference to illegal materials cannot be copyrighted, thank you to JTRaines for posting the warez.
3)Gambino never even paid Rush in full like the contract states so it's all void regardless.
When I spoke with Gambino about a week or two ago about the VSN merge. This is the conversation.
Me: So the VSN merge was a complete and utter failure?
Gambino: No, it was very successful because there is power in numbers. We now have more members and a much higher post count.
Meaning the actual people who posted didn't matter at all, it was the actual "numbers" that were important in this situation.
The deal with the shitty "up and down" crashes was due to incompetent hosting which Argath can attest to. Argath is handling the technical aspects of the site, so there is nothing to worry about on that front. If you have any more questions or just want to rage, feel free to blather on.
All the while I had members from every VSN-spinoff IMing me, emailing me, facebooking me asking me and Leftwich to remake VSN. 150+ people back in less then 48 hours....this place is turrible right?
