Again. Vick's prison time was a result of breaking a Federal law and running an illegal multi-state venture. Vick saw little to no time as a result of killing dogs.

You can't even seriously compare the two. It's apples and oranges. One was vicious, intentional acts of violence, and the other was negligence and an accident, w/ no intent of any harm. Absolutely no comparison. You would have a point if Stallworth had intentions to kill somebody. Otherwise, a comparison can't be made.

That's like comparing a serial rapist to someone who accidentally shoots his hunting buddy. Death penalty to the hunter because he actually killed someone?

Technically the pedestrian has the right of way always. And the fact that Stallworth flashed his brights meant he saw the guy.

I seriously didn't know who has the "right of way" when someone is illegally crossing the street. It doesn't seem real clear cut when someone can run out in front of your car.

In Stallworth's case, he did have time to flash his lights. I don't know if he had enough time to stop the vehicle. I don't know enough details. Flashing lights and hitting the break may take the same amount of time, but actually stopping the car takes longer. So I have no idea if the accident could have been avoided or not. Flashing the lights and not hitting the breaks seems like a REAL BIG MISTAKE. Along with getting behind the wheel after drinking.

He would probably get off pretty easy though since the guy was jaywalking, and he didn't flee. Unless of course he was impaired, which he was. In that case, most of your rights as a driver (including right of way) kind of go by the wayside.

My comments aren't to excuse Stallworth for DUI. I was really just trying to make the point that you can't compare this with MV like Dave was trying to do.

Stallworth faced 15 years in prison. According to the plea agreement, Stallworth needs to serve only 24 days of his 30-day sentence. Murphy agreed to give Stallworth credit for the one day he already served, April 2, which was the day of his arrest and booking. In addition, Stallworth received an additional five days of credit because of a Florida state statute stating anyone who is sentenced to 30 days (besides civil, contempt, drug treatment and house arrest cases) automatically gets five days' credit time served for every 30 days, spokesperson Janelle Hall of the Miami Dade County Corrections Department told Naqi.

After his release from jail, Stallworth must serve two years of house arrest and spend eight years on probation.

Stallworth must also undergo drug and alcohol testing, will have a lifetime driver's license suspension and must perform 1,000 hours of community service. Lyons said after five years, Stallworth could win approval for limited driving for reasons such as employment.

the ignorance is running wild in this thread. Its sad that people just speak on a subject with no factual information at all.

there are other factors that play a role here
1st and foremost is that stallworth has been extremely cooperative during the entire process, he has also reached out to the family and made peace with them (as best as he could)
2nd, the family also wanted to put this behind them. Yes a settlement was reached, but they still wanted to get this whole thing over with. And that is huge in a case like this.
3rd, The prosecutions case was less then perfect.

Not true at all. He was not in the crosswalk and jumped right out in front of stallworths car. Drunk or not, if someone jumps out in front of a car doing 50 mph, you are gonna hit them. And the speed limit was 40, stallworth was going 50.....most people drive 5-10 mph over the speed limit

4th. Stallworth is not some d-bag fuck up. He is a young guy who made a horrible mistake. Has no criminal record and was not trying to get away with anything here. He knows he fucked up and will have to live with that for the rest of his life.

Prison isnt always the best way to achieve justice. He has 30 days, 2 years house arrest, 8 years probation, 1000 hrs community service, he can never drive again (he can apply for work privileged in 5 years), paying a what im sure is a huge settlement to the family....the guilt of killing a man, his career is screwed in the immediate future.....not to mention, he is a christian so he still has god to deal with.
