Intent really does mean something. I can forgive someone that had no intentions of doing any harm. I have a hard time forgiving those that are intentional cruel (like the serial rapist).

I would think that intent would also be an indicator of whether that person is rehabilitation and would learn from what happened. I don't put as much stock in rehabbing the serial rapist.

But listening to Around the Horn and PTI, it sound's like he is still going to be able to play right away this season as long as Goddell doesn't step in and hand out an NFL Suspension.

I'm not exactly sure how it works but I know people who have had jobs on house arrest. I'm sure he'll be able to play all the home games, and maybe most away games as long as he's home early enough in the day...to spend all those hard cold nights in his million dollar home playing with million dollar toys.

If Dante flashed his lights and saw him, should he have not avoided the man. To me, if you see someone and have enough time to flash your lights at them, shouldn't you already be on the brakes getting ready to avoid the person.

This LINK will explain reaction time and breaking distance. But to break it down for you so you don't even have to look, he most likely had an overall stopping distance of 175 feet. Now it doesn't say it in the link, but the typical stopping rate is 20 feet per second. 175/20 fps = 8.75 seconds. That's a LONG time to react, so yeah I think you're right, he should have had a long time to react.

BUT, we don't know what Rayes was doing. It's entirely possible that Donte did react, tried to avoid Mr Rayes, but in those few seconds Rayes jumped the wrong way and into the cars path.Have you ever been walking toward somebody and you both move in the same direction and then at the same time you both move back and you still both end up blocking each other? Nobody knows what Rayes reactions were.

I think it's hard to believe Donte would have time to flash his lights and not brake or swerve. But even if he were to flash his lights and hit his brakes he still had to travel 175 feet and had 8.5 seconds before impact. How many times can you flash your headlights in 8.5 seconds?

Some can argue that him stepping into that car drunk is intent.

The problem with intent is that being intoxicated could legally negate intent altogether, if the defense would assume impaired decision making. Because of this DWI/DUI charges are considered liability charges, and are not subject to intent.

There is no justification for 30 days in jail in this particular case.
The only reason the family agreed to it was money.
No ordinary Joe would ever have gotten off this lightly - and nor should they.

That's the thing though, because it appears the tipping point for the family was the financial settlement. An ordinary Joe doesn't have access to money like that, which is why Joe tends to go to jail for years for similar offenses. Its not so much that athletes or entertainers get special treatment as much as its about these people have access to large amounts of money. IF Joe has access to money he'd be abile to avoid serious jail time as well.

30 days in jail
2 years house arrest
8 years probation
drug and alcohol testing
lifetime driver's license suspension
1,000 hours of community service

I understand the 30 (24) day jail sentence isn't much, but I will tell you that 2 years house arrest, 8 years probation, drug and alcohol testing and a lifetime license suspension aren't a walk in the park. Stallworth is going to have to be on his P's and Q's for the next 8 years or he'll go to jail on a probation violation. That isn't a life I'd want to live.

To me, this is really up to the victims family and the judicial system. I'm making no statements on what the penalty should or should not be. I'll let the victims family decide what they want.

But, no matter what you say....There was no intent to harm someone. Stallworth was irresponsible, negligent and criminal, but not a murderer. It was an accident that may have been caused by negligence and irresponsible behavior.

I can separate intentional from unintentional. I can separate what was intentional and what was not intentional.
