See, that's your problem, You think you made it clear by comparing it to a situation which has absolutely no relevance.
It is relevant when discussing intent. That's all it was trying to do was illustrate intent. Whether someone has intent to kill someone or not. The difference between murder and negligent homicide. It is relevant.
I don't see any comparison between an accident caused because of sheer arrogance which any way you slice it, is caused by one man's INTENT to drive a vehicle under the influence when he knows exactly what he is doing to a situation where the person who would pull a trigger in your little anti-drug commercial supposedly doesn't know what's going on..
One is intentionally driving drunk.
The other is intentionally holding a gun while wasted. He let the guy hand him the gun.
Both are irresponsible.
Neither intends to do any harm.
Neither one is a murderer.

To me, this is really up to the victims family and the judicial system. I'm making no statements on what the penalty should or should not be. I'll let the victims family decide what they want.
But, no matter what you say....There was no intent to harm someone. Stallworth was irresponsible, negligent and criminal, but not a murderer. It was an accident that may have been caused by negligence and irresponsible behavior.
I can separate intentional from unintentional. I can separate what was intentional and what was not intentional.
Driving drunk...Intentional....Doesn't make someone a murderer
Hitting and killing a pedestrian...Unintentional
Murder needs intent....You don't accidentally murder someone.
