Ryan Braun wins appeal of suspension

NEW YORK -- National League MVP Ryan Braun's 50-game suspension has been overturned by baseball arbitrator Shyam Das.

The decision was announced Thursday by the Major League Baseball Players Association.

An outfielder for Milwaukee, Braun tested positive in October for elevated testosterone, and ESPN revealed the positive test in December.

No reasoning was given for Thursday's decision.

"Today the arbitration panel announced its decision, by a 2-1 vote, to sustain Ryan Braun's grievance challenging his 50-game suspension by the commissioner's office," a statement from the players' association said.

Rob Manfred, MLB's vice president for labor relations, was incensed at the ruling, saying in a statement:


"Major League Baseball considers the obligations of the Joint Drug Prevention and Treatment Program essential to the integrity of our game, our Clubs and all of the players who take the field. It has always been Major League Baseball's position that no matter who tests positive, we will exhaust all avenues in pursuit of the appropriate discipline. We have been true to that position in every instance, because baseball fans deserve nothing less.

"As a part of our drug testing program, the Commissioner's Office and the Players Association agreed to a neutral third party review for instances that are under dispute. While we have always respected that process, Major League Baseball vehemently disagrees with the decision rendered today by arbitrator Shyam Das."

Is this like when the (I think it was) California Athletic Commission knocked down James Toney's suspension for steroids because he stood in front of them and basically said, "Do I look like I'm on steroids?"

I need to hear more. Unless there is proof that the test result was bogus, this is horrible news that will cripple the integrity of the testing process.

The 2-1 vote suggests that he did test positive for a banned substance, but convinced two voters that it wasn't intentional. If so, that's lame. Players should be responsible for what they put into their bodies, end of story, no bending, no exceptions, or testing can not work.

If this is true, what a disgrace that he ended up winning this.

From a public relations point of view, he will never recover. He would have been better of crying about herp meds and accepting the suspension. At least these would have been a cloud of doubt from some. Now, he looks like a cheater who exploited a loophole.

This is what I was saying in the chat box.

If this is really the reason he won, I think his rep is damaged pretty badly. When athletes are contrite and honest, people forgive. If Braun keeps insisting on his innocence, when in reality it's a loophole/fuck up that got him off, I think it's a PR disaster for him and he would have been better off taking the 50 and leaving a cloud of doubt in peoples mind.
