[PS3] Sony's PS3 Security is Epic Fail

But I read somewhere that these guys do have PayPal accounts that people have been "donating" money to all because of this and that is one of things Sony is attacking. If they can prove a direct correlation wouldn't these hackers be screwed?

as long as they are not charging for the software or mods I dont believe so as a donation is not for a service and im sure the judge would look at the definition

I just read the legal docs and Sony tried sending money to geohot's paypal account right before filing their motion. His lawyer was all over it.
 
I am also curious to see how this plays out. It may just be Sony trying to use scare tactics, at least thats what these hackers are hoping for.

No court order against PlayStation hackers for now

A San Francisco federal judge declined to order New Jersey-based hacker Geohot to turn over the technology he used to root the PlayStation 3, saying she doubted Geohot was subject to her court's authority.

The move by US District Judge Susan Illston on Friday was a blow to Sony, which argued that the 21-year-old hacker, whose real name is George Hotz, should be forced to surrender his computer gear and the code he used to circumvent digital rights management features in the gaming console. Illston rejected arguments that Hotz's use of Twitter, PayPal, and YouTube, all located in the Northern District of California, were sufficient contacts with the region to establish personal jurisdiction.

“If having a PayPal account were enough, then there would be personal jurisdiction in this court over everybody, and that just can't be right,” Illston told James G. Gilliland Jr., an attorney representing Sony. “That would mean the entire universe is subject to my jurisdiction, and that's a really hard concept for me to accept.”

Sony's motion for a temporary restraining order came in a lawsuit it filed on Tuesday against Hotz [1] and more than 100 individuals who belong to a hacking collective known as fail0verflow. At the Chaos Communication Congress in late December, fail0verflow members revealed the key used to sign PS3 games and demonstrated how to use it to run homebrew apps on the console. A few weeks later, Hotz independently deduced the “metldr” key, which allowed him to root the PS3.

Sony's suit claims that by publishing the means to bypass the protection measures built into the console, the hackers violated provisions of the Digital Millennium Copyright Act. It also claims they violated the Computer Fraud and Abuse Act “by transmitting in interstate and foreign commerce a communication containing a threat to obtain information from a protected computer without authorization.” Both laws carry stiff civil and criminal penalties.

Sony attorneys asked Illston to order Hotz and the other hackers to give Sony “any and all computer hardware” and software used to root the PS3. They are also seeking unspecified monetary damages.
Suit lambasted by critics

The action has been lambasted by technologists and legal scholars who believe that people should have the right to do what they want with the hardware they own.

“You bought the computer,” George Washington School of Law professor Orin Kerr wrote [2] on The Volokh Conspiracy blog. “You own it. You can sell it. You can light it on fire. You can bring it to the ocean, put it on a life raft, and push it out to sea. But if you dare do anything that violates the fine print of the license that the manufacturer is trying to impose, then you're guilty of trespassing onto your own property. And it's not just a civil wrong, it's a crime.”

As Christopher Soghoian, a Ph.D. candidate in Indiana University's School of Informatics and Computing program, blogged on Friday [3], the PlayStation rooting was inevitable following last year's highly controversial disabling of the OtherOS [4], which made it easy for users to install Linux on the PlayStation. Sony took that action to disable an earlier hack [5], released by Geohot, that allowed full memory access, including ring 0 access from OtherOS.

“Users were thus given a choice,” Soghoian wrote of Sony's decision to disable OtherOS. “If they kept the old firmware, they got to keep using Linux, but lost access to Sony's Playstation Network, and the ability to play games online. Alternatively, users could upgrade the firmware, keep playing new titles, but lose access to the Linux functionality.”

The use of IBM's Cell processor makes the PlayStation ideal for performing brute force crypto attacks [6], among other things. Once OtherOS was removed, people who wanted to use the console for such uses had little choice but to hack it.

Hotz was among the first to jailbreak Apple's iPhone so it would work on carrier networks other than AT&T's. Last year, the US Copyright Office exempted iPhone jailbreaking from the DMCA [7] so that they can run apps not officially sanctioned by Apple.

Illston said she may still decide that she has jurisdiction over Hotz if presented with evidence of more substantial contacts to Northern California.

Sony To Go Back To Serial Codes For PS3 Games?

A rumor has popped up saying that Sony is scared enough of a recent PS3 security leak that it is planning to require serial code inputs for all future PS3 titles. Apparently it's 1991 again.

The hack in question is the recent publishing of the PS3's root keys, which can be used to get access to the inner workings of the PS3. While undoubtedly a setback in Sony's ongoing struggle against piracy, the PS3 had hardly proven unhackable previous to the root key discovery.

The rumored scheme would require gamers to input a serial number like PC CD-keys of old and verify them with Sony's authentication servers. The codes would allow five activations, sharply limiting each game's resale value.

While Sony certainly has the right to do what it can to limit piracy and protect its intellectual property, saddling legitimate consumers with a pain-in-the-ass code input that also restricts the end-user's ability to give away or resell their games is pretty *** unfriendly to gamers.

Anyone who follows the industry knows of the piracy-related struggles that PC developers have suffered through since the medium's inception. Digital rights management schemes have come and gone, rarely un-cracked for more than a few months at a time, and piracy has continued. Pissing off consumers, on the other hand, has never to my knowledge been a winning business strategy for anyone.

I'm hoping that this rumor ends up being just that. Introducing new annoyances for legitimate consumers without adding any value is not the way to combat piracy – it's a way to drive gamers to other platforms that don't irritate them. And I'm pretty sure there's another console out there directly competing (and clearly outselling) the PlayStation 3 that Sony would be wise not to give away any advantages to.

On second thought, if Sony wants to print code wheels that you have to use to decipher hidden messages in game manuals in order to play the game, I'm cool with that. Those were sweet.

Sony just released a firmware update about an hour ago to try and patch the vulnerability created by the root keys being made public and apparently it has already been hacked. Sony's PS3 engineers might just want to take the rest of the week off.

PS3 Firmware 3.56 Is Now Live: Takes Shot At Hacks, Doesn’t Work

A new PlayStation 3 Firmware is now live. This is a minor security patch, so don’t expect any major new features to be included. Though, this may be a blow to all of the recent hacks, homebrew and piracy concerns.

[Update] That didn’t take long did it? Hackers are claiming that the new keys have already been decrypted and are working on ways to continue to run homebrew and custom firmware.

[Original Story] It’s not exactly clear what has been included in this firmware, but chatter on Twitter suggests that the update contains a new .SELF with an unknown key, thus thwarting the recent efforts of hacks, homebrew and custom firmware.

Eric Lempel on the PlayStation.Blog mentioned it was a small security patch. But if breaks homebrew and CFW, it’s anything but small.

geez. how do you release a patch that fails right away. wouldnt u fully test it before releasing.

the info about the serial code is very disturbing. what if i am a gamer who takes his game to several different friends home and play it there. sure its got a 5 time activation, but i own the game and 5 times might not be enough. Then of course if you like to buy used....or rent games, u basically are fucked because of this. So much for gamefly or blockbuster

A California court has granted Sony's Motion for a Temporary Restraining Order and Order of Impoundment against George Hotz, the renowned hacker that helped breach the PlayStation 3's security earlier this month.

Hotz, and all parties involved, are now restrained from distributing, providing, or otherwise trafficking in any PS3 security circumvention technology, including: products, services, methods, codes, and software tools, among others. Hotz must also remove any links from his website that directs others to the hacking software.

"Having considered all the papers and arguments, the Court finds that SCEA has shown a likelihood of success on the merits of its claims for violation of the DMCA and CFAA, and that it will suffer irreparable harm unless Defendant Hotz's violations are enjoined," the filing states.

The court also ordered that Hotz must preserve and not destroy computer files, documents, and hard drives containing hacking software. He also must turn over any computers, hard drives, CDs and other storage devices that contain circumvention software in the next 10 business days.

"Obviously, we are disappointed with the ruling granting the TRO," Hotz's attorney, Stewart Kellar, said in a statement given to IGN. "However, this preliminary determination does not end the issue of whether the Court has personal jurisdiction over Mr. Hotz.

"We are continuing to pursue all avenues of defense at this early stage of the litigation."

A hearing date has not been set but all parties must meet before Feb. 1, 2011.

wonder how long till the appeal and if the stuff sony gets they have to give back or if hotz has to give it up right away
